Welcome to Last Shadow. These Terms of Service (“Terms”) govern your use of our website [www.lastshadow.com] (the “Site”) and the services, experiences, and programs offered by Last Shadow, LLC (“Last Shadow,” “we,” “us,” or “our”). By using our Site, submitting a form, or booking an experience, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Acceptance of Terms
By accessing our Site or booking any experience, service, or program, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old to book an experience or enter into these Terms. Participants under 18 may only take part in eligible experiences with the consent, and where required the presence, of a parent or legal guardian. Certain experiences have their own age, health, or eligibility requirements, which will be communicated at the time of booking.
3. Experiences and Bookings
Last Shadow offers guided experiences and services that may include, among others, helicopter hog hunting, exotic hunts, night vision hunts, bow fishing, group and corporate experiences, educational programs, ranch and land management services, and tactical training. All bookings are subject to availability, confirmation, and these Terms. We reserve the right to refuse or cancel any booking at our discretion.
4. Pricing, Payments, and Deposits
Prices are quoted individually based on the experience, group size, and other factors, and are subject to change until a booking is confirmed. A [deposit / percentage] may be required to secure your date, with the balance due [before your experience / as specified at booking]. Prepaid experiences and promotional offers are subject to any additional terms stated at the time of purchase. All payments are processed through our authorized payment methods.
5. Cancellations, Rescheduling, and Refunds

6. Gift Certificates and Prepaid Experiences
Prepaid experiences and gift certificates are valid for [insert validity period, e.g., 12 months] from the date of purchase unless otherwise stated. They are non-refundable, may not be redeemed for cash, and are subject to availability and these Terms. Promotional offers may carry additional restrictions, which will be stated at the time of purchase.
7. Assumption of Risk
You understand and acknowledge that our experiences involve inherently dangerous activities, which may include flight in helicopters, the use of firearms, hunting, water activities, and other physical and outdoor pursuits. These activities carry inherent risks, including the risk of serious injury, death, or property damage. By participating, you voluntarily assume all such risks, whether known or unknown.
8. Safety, Rules, and Participant Conduct
Your safety and the safety of others depends on following our rules and the instructions of our pilots, guides, and crew at all times. You agree to:
- Follow all safety briefings, instructions, and directions from our staff
- Handle firearms and equipment safely and only as directed
- Not participate while under the influence of alcohol or drugs
- Disclose any medical conditions or limitations that may affect your safety
- Comply with all applicable laws and regulations
We reserve the right to remove any participant who violates these rules or endangers themselves or others, without refund.
9. Required Waiver
Participation in our experiences requires each participant to sign a separate liability waiver and release before taking part. These Terms do not replace that waiver. Failure to complete a required waiver may result in cancellation of your experience without refund.
10. Legal and Regulatory Compliance
Our experiences are conducted in compliance with applicable federal and state laws and regulations, including aviation and wildlife regulations. Where permits or licenses are required, they will be handled or communicated as applicable. You agree to comply with all laws and any additional requirements we communicate to you.
11. No Guarantee of Results
Hunting, fishing, and wildlife experiences depend on many factors beyond our control. We do not guarantee any specific outcome, harvest, sighting, or result. Your booking is for the guided experience itself, not for any particular result.
12. Weather and Operational Cancellations
Experiences may be delayed, rescheduled, or cancelled due to weather, safety, mechanical, or other operational reasons at our discretion. In such cases, we will work with you to reschedule. Our liability for such changes is limited as described in these Terms.
13. Media Release
You acknowledge that we may capture photos or video during experiences and may use this media for marketing and promotional purposes. If you do not wish to appear in such media, please notify us in writing before your experience.
14. Intellectual Property
All content on the Site, including text, images, logos, graphics, and branding, is the property of Last Shadow or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our content without our prior written permission.
15. Limitation of Liability
To the fullest extent permitted by law, Last Shadow and its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Site, our services, or your participation in any experience. To the extent liability cannot be excluded, our total liability shall not exceed the amount you paid for the applicable experience or service.
16. Indemnification
You agree to indemnify and hold harmless Last Shadow and its owners, employees, contractors, and agents from any claims, damages, losses, or expenses arising out of your participation in any experience, your violation of these Terms, or your violation of any law or the rights of a third party.
17. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in [Bell County / the appropriate county], Texas.
